2. ORDER


The sale of goods is carried out via the Internet in the form of a remote contract between the customer - hereinafter also the Buyer, Client or Customer and the online store www.breadtradition.com, hereinafter also referred to as the Store, the Seller.
To place an order, the Customer must use the latest versions of browsers: Explorer, Mozilla FireFox, Chrome or Opera. It must have Java Script and cookies.
Before placing an order, each customer of the Store must familiarize himself with the Rules available on our website. The customer is obliged to familiarize himself with the Rules and confirm that he understands their content no later than when registering in the Store or purchasing a product. Failure to accept the Rules makes it impossible to make a purchase in the Store.
Electronic orders can be made 24/7 throughout the year. Orders placed on Saturdays, Sundays and holidays are processed only on the next business day. The store reserves the right to introduce restrictions on the use of the store.
To place an order, you must specify the delivery address (name and surname, street, postal code or InPost box number, city, country) and contact information (name and surname, telephone, e-mail).
If the Buyer does not pay for the order, the Seller has the right to cancel the order.
The person who places the order is obliged to fill out the form completely and in accordance with the facts at the stage of placing the order. In case of providing false, incomplete or incorrect data - the Seller will try to contact the Buyer to supplement or correct them. If communication is not possible, the Seller may refuse the sales contract due to the lack of data necessary to fulfill the order.
After placing the order, the Buyer will receive an automatic response from the website www.breadtradition.com/ confirming the acceptance of the order. In case of system failures, the store www.breadtradition.com reserves the right to confirm the order by phone.
Acceptance of the order for fulfillment occurs in the case of payment of orders by bank transfer directly to the bank account after crediting the payment.
We try to process the order within 72 hours after crediting the amount received from the Client. The delivery time by the courier company should be added to the delivery time (up to 3 working days in Poland and up to 15-20 days in Europe).

The prices of goods in the Shop's offer are expressed in Polish zlotys. Prices in currencies are based on the current exchange rate of the National Bank of Poland. Delivery costs are added separately, depending on the delivery method chosen by the Customer. The cost of delivery is added separately depending on the delivery method chosen by the Customer. www.breadtradition.com reserves the right to change the prices of the offered products without prior notice to customers. The price change does not apply to orders accepted for execution.

After making the payment, the customer is redirected to the order confirmation page, from which he can continue shopping or go to the order summary.
Each time, the goods covered by the Order are delivered to the Buyer by the Seller together with a document confirming the conclusion of the sales contract, i.e. an invoice, if the Customer requested its statement when placing the Order and provided the necessary data for the statement.
Payment for the ordered product can be made by bank transfer through the electronic payment system PayU and Przelewy24.
If the ordered Product is not available in the Store or the Customer's order cannot be fulfilled for other reasons, the Store will inform the Customer by sending information to the e-mail address specified during registration within 3 (three) days from the date of conclusion of the contract.
If the payment for the item of the order, which could not be fulfilled in whole or in part, was made in advance, the Store returns the paid amount (or the difference) to the Client within 7 (seven) days from the date of sending the information.


3. COMPLAINTS AND RETURNS


The store is responsible to the buyer if the sold product has a physical or legal defect in accordance with the terms of the Civil Code (warranty). The Seller is responsible for the warranty if a physical defect is detected within two month from the date of delivery of the goods to the Customer. The claim for defect elimination or replacement of the product with a defect-free one becomes invalid after one month from the date of discovery of the defect. In the case of purchase of the product by the consumer, the statute of limitations cannot expire before the end of the period specified in the sentence. 2.

If the product is defective, the Customer can:

a) to submit an application (COMPLAINT FORM) for a price reduction or to withdraw from the contract, if the seller does not immediately and without undue inconvenience to the client replace the defective product with a defect-free one or does not eliminate such a defect;

b) demand replacement of the product with a defect-free product or elimination of the defect. The seller is obliged to replace the defective product with a product without defects or to eliminate the defect within a reasonable time without undue inconvenience to the buyer in accordance with the relevant provisions of the Civil Code.

The reduced price must be proportional to the price resulting from the contract, at which the cost of the product with a defect remains equal to the cost of the product without defects. The customer cannot withdraw from the contract if the defect in the product is minor.

If the Buyer is a consumer, instead of eliminating the defect proposed by the seller, he can demand the replacement of the product without defects or instead of replacing the product, demand the elimination of the defect, except in cases where bringing the product into conformity in the way chosen by the consumer is impossible or requires excessive costs compared to the method proposed by the seller . When assessing cost overruns, the value of the product without defects, the type and significance of the identified defect, as well as the inconveniences that the consumer would experience with another method of satisfaction are taken into account.

The complaint is considered by the Seller within 14 days from the moment the Seller receives the complaint from the client. The goods that do not meet the terms of the contract are returned to the mailing address together with the check.

The return of the value of the product will be made to the account specified in the return form within 14 working days from the moment of acceptance of the return by the store employees.
Differences arising as a result of individual settings of the Client's computer (color, proportions, etc.) cannot be the basis for a complaint about the purchased product.
The Seller is not responsible for non-compliance of the goods with the terms of the contract, if the Buyer knew about this non-compliance at the time of concluding the contract.
The Seller is not liable under the warranty for defects when the Product does not meet only the individual, subjective feelings or expectations of the customer, for example, the product does not meet the customer's taste preferences.
Complaints are not subject to:
• natural wear and tear of the product;
• goods with mechanical damage caused by, for example, dents, abrasions, deformations or incorrect size adjustment, etc.;
• products with mechanical damage caused by lack of or improper care.


4. WITHDRAWAL FROM THE AGREEMENT

In accordance with the Consumer Rights Act of 30 May 2014 (Düsseldorf of 24 June 2014, Section 827), you may cancel your purchase within 14 days of delivery.
In order to comply with the deadline for withdrawal from the sales contract, it is sufficient for the Client to send information regarding the exercise of the Client's right to withdrawal before the end of the 14-day period.

In order for the return to be made quickly, the goods must be sent in their original packaging and secured.

The returned item must be in the original box, with the label intact, along with the receipt attached and the RETURN FORM available for download under the policy tab.

Return shipping costs are the responsibility of the buyer.

We will issue a refund within 14 days using the same payment methods you used in the original transaction, unless you have expressly agreed otherwise.

The seller may withhold the refund until the returned item has been received and inspected.

The Customer is responsible for reducing the value of the Product as a result of its use in a different way than was necessary to establish the nature, characteristics and functioning of the Product.
 

5. CONFIDENTIALITY AND SECURITY POLICY OF PERSONAL DATA


The administrator of the databases of personal data provided by consumers of the store is the Seller. The seller undertakes to protect personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data., as well as the repeal of Directive 95/46/WE together with the Law on the Provision of Electronic Services dated July 18, 2002. The client's provision of his personal data to the Seller when placing an order is a condition for concluding a contract. If the customer does not provide the personal data necessary to fulfill the order, the Seller will not fulfill the customer's order. A registered and authorized customer can independently correct, supplement or completely delete data from www.breadtradition.com at any time.

6. FINAL PROVISIONS


In all matters not covered by these Rules, the provisions of Polish legislation, in particular the Civil Code and other acts, and in the case of consumers also the Law of May 30, 2014, apply. on consumer rights. The provisions of the Regulation should be interpreted in such a way as to ensure their compliance with current legislation.
All names of the Goods offered by the Store for sale are used for identification purposes and may be protected and reserved in accordance with the provisions of the Industrial Property Law.
The Store contains content protected by intellectual property law, including works protected by copyright (content posted on the Store, layout, graphics, photographs, etc.). Customers and people visiting the Store undertake to respect the intellectual property rights (including proprietary copyrights and industrial property rights, such as rights arising from the registration of Trademarks) granted to the Owner and third parties. Responsibility for non-compliance with the provisions of this clause lies solely with the Customer of the Store or the person visiting the Website of the Store.
